The Stuttgart Administrative Court has ruled that the so-called Heilbronn street racer may be deported. His appeal against deportation to Turkey was unsuccessful.
According to the court, the 23-year-old still represents a significant danger to the public. The judges were not convinced that the risk of reoffending had been eliminated. They also stated that integration in Turkey would be possible.
The case relates to a fatal accident in Heilbronn in February 2023. The driver lost control of a high-powered car while speeding excessively. In a 40 km/h zone, he was traveling at around 100 km/h when he crashed into another vehicle. A 42-year-old man died, while his wife was seriously injured and two children suffered minor injuries.
Earlier, a regional court sentenced him to nine years in prison for murder and attempted murder in three cases. Germany’s Federal Court of Justice rejected his appeal.
Authorities subsequently issued an expulsion order, which obliges a foreign national to leave the country and serves as a preliminary step toward deportation.
The court emphasized that public safety outweighs the individual’s interest in remaining in Germany. It also noted repeated serious traffic offenses and a lack of resolution of the underlying causes of his behavior.
The ruling is not yet final. The defendant may still apply for permission to appeal within one month.
